None of our terms below affect your statutory rights.

1) Definitions:
a)
The “Company” means the seller English Chain Co Ltd T/A Door Furniture Direct.
b)
The “Customer” means the buyer, the Company or person which or who has contracted with the Company for the purchase of goods.
c) The “Terms and Conditions” means these Terms and Conditions of Sale governing the supply of goods sold by the Company.
d) The “website” means www.doorfurnituredirect.co.uk

2) Our Contract:
All orders placed by the customer are on the basis of these Terms and Conditions and are subject to acceptance by us. At the point when you receive confirmation by email that your order has been dispatched, a legally binding contract is constituted between us which will be deemed to have been concluded in the United Kingdom and shall be governed and construed in accordance with English Law and the jurisdiction of the English Courts. Processing of your payment and our email acknowledgement of your order does not constitute legal acceptance of your order. By placing an order through our website, you warrant that:
a)
You are legally capable of entering into binding contracts and you are at least 18 years of age.
b)
The personal information that you are required to provide is true, accurate, current and complete in all aspects.
c) You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

3) Payment:
The Company can accept payment by most of the major credit/debit cards which are securely processed online using our Sage Pay Payment Gateway. We also accept PayPal. Cheques are accepted subject to clearance and should be made payable to English Chain Co Ltd. Acknowledgements and dispatch notifications are normally sent by email and VAT invoices are usually enclosed with your delivery. Alternatively, if requested, invoices may be posted to the billing address. All transactions are in Pounds Sterling.

4) Pricing and Descriptions:
a)
Prices quoted and displayed on our website are both inclusive and exclusive of VAT as indicated.
b)
The price payable for the goods you order is as set out on our website at the time you place your order plus any charges for delivery and insurance.
c)
Where products have options, or are part of a range, the image displayed may be representative of the range rather than the specific option selected. The price initially shown will represent the cheapest option and may change when an alternative option is selected.
d)
Due to the large number of products on our site and despite our best efforts it may be possible that some of the products or delivery charges on our site are incorrectly priced. If a product or delivery charge’s correct price is lower than the stated price we will charge the lower amount when dispatching goods. If the product or delivery charge is higher than the price stated on our site we will contact you for instructions before processing the order. We are under no obligation to sell at the incorrect (lower) price even if you have been sent an order acknowledgement.
e) Any prices used as a basis for comparison (crossed out or was/now prices) are comparisons with our most recent price on products available for 28 consecutive days or more on this website.
f) We take all reasonable care to ensure that all details and descriptions of products appearing on our website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information appearing at a particular time may not always reflect the position exactly at the moment you place your order. Dimensions of products, colours and finish can in particular vary during their manufacturing process and as such all sizes and appearances provided should be treated as approximate. 5) Delivery and Title:
UK MAINLAND (excluding remote areas) - Any free delivery offers advertised on our site will be confirmed during checkout and may vary from time to time. Where delivery is chargeable there will be a £4.98 or £5.99 carriage charge which will be confirmed on screen before your order is processed. We aim to offer weekday overnight delivery on orders placed before 12:00 noon, but please allow 3 working days. If your order is particulary urgent please contact us first to discuss availability and delivery options. Where delivery is not available on a particular item within this time frame you will be informed, and an alternative estimated time for delivery will be advised. We will assume any advised delivery time is acceptable unless we hear from you, but may ask you to confirm your acceptance of this in the case of long delays or specially manufactured items.

To offer maximum convenience for our UK home and business customers we use either Royal Mail services or alternatively a home/business delivery courier service.  Our couriers will normally provide notifications and a delivery window by email or text. Where a delivery notification is provided you will be able to email or text the courier to change the delivery if necessary as advised in the notification.

Where premium delivery services are requested at extra cost, it is the customer's responsibility to be available to receive the parcel as agreed or redelivery charges will apply. The extra cost for these services will be not be refunded should an order be subsequently cancelled for any reason.

UK OFFSHORE and REMOTE AREAS (including Scottish Highlands, IOM and Northern Ireland) – Free delivery offers advertised on our site will be confirmed during checkout and may vary from time to time. Where delivery is chargeable there will be a £4.98 or £8.99 carriage charge. Delivery to Scottish Highlands, Isle of Man, Northern Ireland and Scottish Isles can take up to 3 working days from dispatch.

OVERSEAS (including EU) - Orders from overseas are welcome and the cost to most European destinations will be confirmed on screen as you place your order. Where an on screen price is not possible for worldwide destinations or the consignment is exceptionally heavy or long, delivery charges will be advised by email for your approval before an order is processed. Products delivered may be subject to customs clearance fees, import duties and taxes levied in the destination country (this now includes EU destinations). You will be responsible for payment of any such import duties and taxes of which we have no control and cannot predict their amount. Local customs offices will generally advise on this.

Deliveries are made by our nominated courier and a signature will normally be required on delivery. If you are unable to accept your delivery and do not take appropriate steps to arrange an alternative delivery date, or if delivery fails as a result of circumstances within your reasonable control, the cost of re-delivery shall be borne by you. If we are unable to arrange re-delivery we may cancel your order and refund to you the price that you have paid for the goods, less the failed delivery costs. Any special delivery arrangements out of our control are made between the customer and the courier/driver within the courier’s delivery terms. Title of goods will remain with the company until such time as all goods and delivery charges are paid for in full. Immediately prior to dispatch, title of the goods will pass to you when the order has been accompanied by full payment. The products will be at your risk from the time of delivery.

6) Cancellations, Returns or Complaints:
You may cancel your order for any reason up to 14 days from the day after you receive the goods. To do this, please contact us first specifying the order number of the goods you wish to cancel. You can call 0151 652 3136 during office hours, email [email protected] or use our contact form. Please note that the goods must not have been used and must be returned in fully resalable condition in their original undamaged packing. If you do this it will be your responsibility to arrange and pay the cost of safely returning the goods to us but, apart from this, the whole of your money will be returned within 14 days of returning the goods. The right to cancel your order does not apply where goods have been made to your own specification or clearly personalised in some way.

Goods held for more than 14 days (starting on the day after you receive the goods) may be returned at our discretion and a handling charge may apply. The goods must not have been used and must be returned in fully resalable condition in their original undamaged packaging. Goods will not normally be accepted for return after more than 30 days following receipt. Unfortunately we cannot accept proof of posting as confirmation of delivery and unless otherwise agreed you will be responsible for the costs for arranging and returning the goods to us.

Return costs are the responsibility of the customer, and these costs include any duties or customs clearance fees in the case of international returns which may be deducted from any refund due where duty is unpaid. We can not process any returns and refunds until the goods have been received at our return address so the customer should use an appropriate delivery service for returns.

Please enclose your order ID or authorised details with your return so that we can easily identify the sender and process a prompt refund.

Please inspect your order upon receipt and before fitting. If goods are delivered faulty, incomplete or damaged you must notify us within 7 working days. To resolve the problem, please contact us by either emailing [email protected] or use our contact form to discuss the issue and establish the fault, a picture may also help or inspection may alternatively be required. If we are unable to resolve the problem and a fault is agreed, we will arrange return of the goods. A full refund will be given upon receipt of the item(s) including any standard carriage costs. This does not affect your statutory rights as a consumer.

For all complaints, mistakes and any suggestions for improvement to our service please contact us. We treat all complaints confidentially and will respond to an email within one working day. We have strict internal procedures for dealing with complaints or mistakes and endeavour to resolve them within 5 working days. You will be kept informed throughout the process and your complaint will be treated fairly and with respect.

7) Liability:
We supply only and do not schedule, specify or install our products nor can we guarantee they will meet your particular requirements. For these services you should employ a suitably qualified individual, such as but not limited to an Architect, Surveyor, Joiner or Building Company etc. Any commentary, advice, instructions or other information published or distributed by us (for example but not limited to responses to email questions, telephone enquiries or frequently asked question (FAQ) pages) are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from reliance placed by you or others on such information.

If you have notified us of a problem with the goods within 7 days of delivery we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

We will not be liable to pay any money by way of compensation for losses related to any business of yours including but not limited to loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; disappointment or any other loss either indirect or consequential arising out of any problem in relation to the goods other than any refund we make under these terms and conditions.

We cannot accept liability for damage caused by faulty fitting or abuse of the item.

If you are a trade customer, we will not be responsible to you or, in the event that you are undertaking work for another person, to any other person, for the use or installation of any goods we supply to you. You agree to hold us blameless, and indemnify us against any liability associated with any claim or allegation that we are responsible for, any failings in the installation or use of the goods supplied by us.

While we use all reasonable care to verify the accuracy of any information we place on the website, we make no warranties whether express or implied in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind whether express or implied, in relation to the website, the products and their descriptions, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, condition of completeness, or any implied warranty arising from course of dealing or usage or trade

We will not be liable for any failure of our obligations under a contract for events outside our reasonable control, a “Force Majeure Event” (such as but not limited to: Industrial action; natural disaster; civil unrest or war; failure of third parties to deliver goods; failure of communication networks; Government actions). Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues. We will make every effort to bring the Force Majeure Event to a close or find a solution to satisfy our obligations under the Contract despite the Event.

We are unable to confirm that goods comply with any laws, regulations and standards outside the UK. We will not be liable for any breach by you of any such laws.

None of the above affects your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

8) Unavailability:
In the event that a product is unavailable or we have insufficient stock to supply or deliver for whatever reason, we will contact you with a revised delivery date or ask you whether you would like us to supply a suitable alternative if appropriate and available. We will not supply you with an alternative product unless we receive instruction from you that you wish us to do so. We do not charge your card until we dispatch your order but if you have paid by PayPal or another form of instant payment, we will refund the full value of the product and any applicable carriage charges.

9) Age Restricted Goods:
When you place an order for goods which are age restricted by law such as knives and solvents, you confirm that you are over the age of 18 years. We may instigate control checks to verify your age and cancel your order should we reasonably believe you are not legally entitled to order such goods.

10) Security:
Our online store uses secure socket layer encryption (SSL) via a separate secure server. This ensures that your transactions with us are protected and no third party can access your personal details. Cookies (small text files stored by your browser on your PC's hard drive) enable our store to remember your name, billing address, shipping address, phone number, email address (but not credit or debit card information) so that you don't have to re-enter it each time you use the store. The system also uses cookies to remember what is in the shopping basket from page to page and for measuring how you use the website so that we can make sure it meets your needs. 11) Privacy:
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. To process your order it is necessary to pass details including mobile telephone numbers to our carriers to enhance the delivery service and the carrier will use notifications and geodata for that purpose. For the purpose of providing the service the carrier may in turn share the personal data with it's agents, subcontractors, affiliates or other limited third party service providers for the purpose of providing or improving the service. Other than is necessary to process your order, we do NOT pass your information to any other third parties. The type of information we will collect about you includes: your name, billing address, shipping address, telephone number, email address and credit/debit card details. We will never collect sensitive information about you without your explicit consent. The personal information which we hold will be held securely in accordance with our internal security policy and the law.

We will not email you in the future unless you give your consent. If you choose to be put on our mailing list you may receive News and Offers from time to time. If, after having given consent, you wish to stop receiving any information about us and our services please email [email protected] . You can check the information we hold by emailing us. If you find any inaccuracies we will delete or correct it promptly.

To ensure compliance with GDPR we use legal bases for processing your personal data.
Consent - Where you have given clear consent for us to process your personal data for a specific purpose.
Contract - Where you are a customer, or are in the process of negotiation to become a customer.
Legal Obligation - Where the processing is necessary for us to comply with the law.

All Copyright, trademarks and other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. The material and content contained within the website is made available for your personal non-commercial use only. You may only download such material and content if necessary to make a purchase and on to one computer for such purposes. You agree not to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material or content nor to assist or facilitate any third party to do so.

13) Waste Electrical or Electronic Equipment:
The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. As a responsible distributor, we have met the requirements placed on us by financially supporting the national network of WEEE recycling centres established by local authorities. This is achieved through membership of the national Distributor Take-back scheme (DTS).
